What Filing Can Change

The day you file, a court order called the automatic stay goes into effect. Here is what that usually means for the calls we get most.

A nurse on break in a Jackson hospital checking her phone
Now

A Garnishment Takes Part of Every Check

A creditor got a judgment, and your employer is holding back pay.

After you file

Most Garnishments Stop

The stay stops most garnishments. Child support and alimony are the big exceptions.

A homeowner watering ferns on the steps of her brick house in Jackson
Now

A Foreclosure Letter Came

You are months behind and the bank set a sale date.

After you file

The Sale Is Paused

Chapter 13 can let you catch up the missed payments over three to five years while you keep paying the normal note.

A man getting into his pickup in a Madison County driveway before work
Now

The Truck You Need for Work Is at Risk

Two notes behind, and the lender is calling about repossession.

After you file

Time to Work It Out

The stay stops repossession for now. We look at catching up in Chapter 13 or keeping it in Chapter 7.

Attorney Renee Loftin on a call with a client in her Fondren office

    No Lectures. Just the Numbers.

Renee Loftin has filed bankruptcy cases in the Southern District of Mississippi for 14 years. Most of her clients got here from a layoff, a divorce or a hospital bill.

Nobody plans to be here. My job is to show you the way out and let you pick it.
    • You meet Renee on the first visit, not a salesperson.
    • We file both Chapter 7 and Chapter 13, so we have no reason to push one.
    • Evening visits on Tuesdays for people who cannot miss work.

The garnishment on my check stopped and I could breathe again. Renee never once made me feel ashamed.

We thought we would lose the house. She laid out Chapter 13 on one sheet of paper and it finally made sense.

Kayla answered every question, even the dumb ones. The whole thing was calmer than I expected.

    Plain Answers

Will I lose my house or car if I file?

Many people who file keep their home and car. Mississippi exemptions protect a set amount of equity, and Chapter 13 can let you catch up on missed payments. We go over what is at risk before you decide to file.

    Does bankruptcy stop wage garnishment?

Filing starts the automatic stay, which stops most garnishments, lawsuits and collection calls. It does not stop child support or alimony collection.

    What is the means test?

It is a check on whether your income is low enough for Chapter 7. First we compare your last six months of income to the Mississippi median for your household size. If you are over, we subtract allowed expenses to see what is left.

How much does it cost to file?

Our Chapter 7 fee usually runs $1,100 to $1,500, plus the $338 court filing fee. Chapter 13 has a $313 filing fee, and most of our fee is paid through the plan. We quote your fee in writing on the first visit.

How long does bankruptcy stay on my credit?

A Chapter 7 can stay on your credit report for up to 10 years and a Chapter 13 for up to 7. Many people start rebuilding right away, because their old debts are no longer weighing down the report.
